IMPORTANT-PLEASE READ PREDATORY TOWING ACT UPDATE


In January we announced Governor Christie had signed S-3459 into law amending the Predatory Towing Act by exempting law enforcement tows from certain provisions of the Act. The intent of the changes were to re-establish the authority to regulate towing ordinances and operating procedures in the hands of municipal and state police.

We received a letter from the Division of Consumer Affairs notifying us that the changes did not provide the exemptions and law enforcement tows are still subject to the requirements of the Act.

We have reached out to Senator Sarlo and DCA and are in the process of setting up meetings to rectify this issue.

In the meantime, we advise that you follow the Predatory Towing Act as it applies to police towing.

THIS ISSUE WILL EFFECT EVERONE- EVEN IF YOU ARE NOT CAUSING THE PROBLEM

We have got to get a handle on overcharging. Currently, we have the American Trucking Association, OOIDA, the Insurance Council and two pieces of legislation in the state who have researched and collected data on the issue of overcharging and want to regulate commercial pricing in the towing industry.

Since the last snow storm we are dealing with several complaints regarding overcharging on the state police rates. We have been contacted by the state police who now want to review some of the implemented rates. The new rates for the state police SOP are the best rates we have ever been able to implement and we are in danger of losing them.

The association is inundated with fighting against these regulations, but in the end if we can’t get the problems resolved ourselves at some point in the near future we are going to lose this battle. As you are aware, when regulations are enacted the good guys get punished for what the bad guys are doing.

We are in the process of arranging a meeting to specifically discuss these issues with our members. When the meeting is confirmed we strongly advise your participation.

For voting purposes, the record date for determining members shall be 30 days prior to the meeting wherein an election is to be held or any other action is to take place requiring a vote of the membership.



MEMBERSHIP UPDATES & CURRENT ISSUES

PREDATORY TOWING


We are very aware of the issues many of you are dealing with from the Division of Consumer Affairs. After working within the guidelines of the act since its inception, there appears to be a new interpretation of these rules. We have contacted the Director Steve Lee and are setting up a meeting with him.

ABANDONED VEHICLES


Again, we are facing different interpretations of this process from agencies all over the state. We have requested a meeting with the Commissioner Raymond Martinez.

LIABILITY INSURANCE


We have a meeting scheduled with the Insurance Commissioners office to discuss the issue of underinsured trucks and getting paid for incidents. If you have questions or comments PLEASE put them in writing and email or fax them to the GSTA office. Please be patient as we work to get answers and resolve these issues. We will keep you informed.

NJ TURNPIKE INCREASE


NJTA needs to open the comment period on the revised towing rates rulemaking notice for another 30 days, to insure compliance with the Administrative Procedures Act. A link to the Rulemaking Notice is below:

If no comments were received by February 9, the revised regulations will be published for adoption in the next available NJ Register and will take effect upon publication.

IN THE SPOTLIGHT!

William J. Pollinger

William J. Pollinger was the first attorney for the Association. He authored the original By-Laws and copyrighted the Association's logo.

Mr. Pollinger represented towers in suits against municipalities, forcing them to create tow ordinances or place tow contracts out for bid, to level the playing field for all.

Mr. Pollinger wrote the statute allowing municipalities and counties to utilize licensing ordinances rather than bids to regulate towing.

Known throughout the state regarding all issues arising out of the towing industry, Mr. Pollinger has been successful in challenging provisions in ordinances and bid specifications in many cases, from the Trial Court to the Supreme Court, benefiting clients and the industry. He has assured that his clients are treated fairly and awarded the licenses and contracts they deserve.

Mr. Pollinger has recovered hundreds of thousands of dollars in unpaid fees for services performed by towers for recovery, towing and storage.

His decisions include the right to sue leasing companies for storage fees incurred by lessees; the right to a hearing by the low bidder prior to rejection of its bid; and the right to sue owners for fees after their vehicles have been auctioned.

Mr. Pollinger continues to wage campaigns at all levels of government and in all courts of the state for and on behalf of towers and the towing industry.
