LATEST NEWS: SENATE BILL S-2759

PREDATORY TOWING PREVENTION ACT

ATTENTION ALL NJ TOWERS

 Senate Bill S-2759 Predatory Towing Prevention Act passed the NJ Assembly and the Senate Committee; was SIGNED INTO LAW by Governor Corzine on October 24th, 2007.

 This legislation will require ALL Towing Companies to file a tariff  and obtain a license with the NJ Division of Consumer Affairs.

PLEASE PASS THIS INFORMATION ALONG TO EVERY TOWING COMPANY IN NJ. THIS LEGISLATION IS THE WORST TO HIT THE NJ TOWING INDUSTRY SINCE THE INSURANCE REFORM ACT. NOW, MORE THAN EVER WE NEED YOUR MEMBERSHIP, WE NEED YOUR VOICE, WE NEED YOUR SUPPORT AND YOU NEED US TO REPRESENT YOUR CONCERNS WITH THE LEGISLATORS!

 

THE ENTIRE NEW JERSEY TOWING INDUSTRY IS IN JEOPARDY!

      GSTA, NJGCA, and AASPNJ have all worked to stop this law from becoming reality.

 

In an effort to prevent UNAUTHORIZED Predatory Towing, the NJ Legislature has passed legislation that will require ALL TOWING COMPANIES or anyone that OWNS or OPERATES a TOW TRUCK to comply with burdensome regulations.

 

However, as often happens in the legislative process, the original intent of this bill went beyond its original focus and throws a net over every single tow truck in NJ.

 

The new law will require:

 

1) ALL tow trucks to be registered with the NJ Department of Consumer Affairs.

2) Cumbersome forms to be filed annually for each registered tow truck.

3) Fees to be paid annually for each registered tow truck. The amount of the fee is yet undetermined but you can bet it will be significant because:

  •          The legislation specifically states that the fees you pay for each registered tow truck and fines will be the only source of funding for this newly created bureau.

4) ALL of your rates and fees for towing, recovery, and storage services must be filed with the NJ department of Consumer Affairs. Your rates will be posted on a web site for all of your competitors and customers to view.

5) The Director of NJ Consumer Affairs will set ALL towing rates in each county based on the average of all rates filed.

6) Fines and penalties for non-compliance.

     actions with this Legislation!

 

Dear Member and New Jersey Towing Company Owner,

 

The association has not wavered in its efforts to fight the effects S-2759 will have on our industry. In addition to interviewing Attorneys and Lobbyist Groups we’ve been in contact with the Division of Consumer Affairs, the Governor’s office and the League of Municipalities.

 

With all the information we’ve obtained we’ve determined that actively pursuing a Lawsuit is not the direction to go at this time. With the advice from GSTA Attorney Bob Martin and TRAA Attorney Pete O’Connell we’ve been pursuing a Lobbying firm that has expertise in “regulatory lobbying”. This enables us to try to work with the Legislators and government agencies in an effort to modify the language of the Law that has the most detrimental affect on our industry.

 

If we’re able to successfully work within the regulatory process by introducing and passing Corrective Legislation, a costly lawsuit in Federal court may not be necessary. The meeting we have scheduled for January 24th with a counsel to Governor Corzine will give us the answers to many questions and will be pertinent to what direction we’ll need to pursue next.

 

I’ve also included the correspondence the League of Municipalities has had with their Municipal Officers and the Division of Consumer Affairs. The concern of how the Law will affect existing Municipal ordinances and contracts is laid out in these documents. Basically it says that there will be no changes until October 18, 2008; however after that date the DCA will set the fees and will include ALL towing services allowed to be charged based on what is submitted to them at the time of registration.

 

That’s where your Executive Board is currently on the issue of pursuing the affects of the “Predatory Towing Prevention Act S-2759”. I’d like to take some time to address you, the member and what you can do to help the association successfully defeat this issue and the adverse affect it could possibly have on the way our industry currently conducts business. You, as a business owner and GSTA member need to:

 

  • Actively “get involved” with your association. We can’t do it alone, we need your “informed involvement”. We realize you’re all very busy, but this Legislation is important to the future of your business. Becoming informed and involved is imperative to a faster and more successful resolution.

 

  • Familiarize yourself with every aspect of this Legislation. Read the faxes we send out, review the web sites, read the Law, question your local municipal officers and come to the meeting with questions, advice and comments.

 

  • Contact every towing company owner you know. Whether they’re members of GSTA or not, they will be affected by this legislation. They will be held to the same regulations as you are, if they’re not aware of what’s going on, their responses to the DCA will affect your bottom line.

 

  • Make a monetary contribution to the Legal/Legislative Fund. Any type of action by the association on this legislation is going to cost money. Your membership dues and any small fund raisers we do throughout the year cover the cost of the associations operations only. There isn’t enough money to cover legal costs; especially of this magnitude. If you were to pursue the expenses of fighting this legislation on your own it would cost you thousands of dollars and still the affect of ONE Towing Company would be miniscule compared to the affects of hundreds of companies working together. We need your monetary support to hire the lobbyists and or attorneys that it’ll take to successfully overhaul or abolish this Legislation.

 

You can rest assured your association will NOT let this issue rest. The entire Executive Board and I are relentlessly committed to pursue this issue regardless of the cost in time, effort and money. Every day either I or another Board member is on the phone talking to someone that can help us affect the necessary changes to ensure this Law will have no adverse affect on our industry and the way we currently conduct business. If you haven’t heard anything from us, check your faxes or call the GSTA office for an update. Fighting Legislation is a long and tedious process; it’s never a simple overnight resolution. It takes time, effort, patience and a strong commitment and we are that involved and determined.

As many of you know, I am counsel to the Towing and Recovery Association of America (TRAA). I also represent the Conference of Northeastern Towing Associations (CNTA) and the Empire State Towing and Recovery Association (ESTRA). GSTA is a member of both TRAA and CNTA. John Glass has asked me to provide this analysis of the above bill, which is currently before New Jersey Governor, John Corzine, for executive action.

 

I find this bill to be one of the most dangerous bills that I have seen in my 26 years of representing the towing industry. Although its stated purpose is to reign in a small number of rogue towers who engage in so-called “predatory towing” practices, it actually seeks to re-regulate the entire towing industry.

 

Specifically, the bill requires all New Jersey towers to file a separate tariff for each and every service that they provide – whether the service is consensual or non-consensual. Once filed, a tariff cannot be amended more than once in a three month period of time. These tariffs, which could possibly include contracts with private customers, will be posted on a website that will be maintained by the Division of Consumer Affairs. It is anticipated that fees to cover the administration of the law – which will be passed on to towers – will be substantial.
 

Private property towers would be subjected to additional restrictions. It would be unlawful to tow from a parking lot during business hours unless the owner of the lot (or an agent or employee) is present. If the vehicle owner shows up, the vehicle must be released without charge. Accommodations must be made to release vehicles after business hours – again at no charge to the customer.

 

The bill is very poorly written. A provision that makes the granting of “preferences” unlawful would appear to outlaw contracts that contain rates that are below rates that are offered to the general public. It also ignores Federal Law. Requirements to file tariffs – particularly for non-consensual towing services – are in clear violation of the federal ICC Termination Act of 1995.

 

I would urge all GSTA members to assist your association in opposing this bill before the Governor. I see no recourse but to sue if this bill becomes law and lawsuits of this nature can become extremely expensive.
